2. Service Description

MotionFy is an automated studio system that creates high-end product visuals and motion assets for performance advertising. The Service allows you to:

  • Upload product images
  • Select ad types and visual styles
  • Generate AI-powered hero images and video ads
  • Download generated content for use in advertising campaigns

3. Account Registration

To use certain features of the Service, you must create an account. When registering, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activities under your account

You must be at least 18 years old or the age of majority in your jurisdiction to use the Service.

4. User Obligations

When using the Service, you agree not to:

  • Upload content that infringes on intellectual property rights of others
  • Upload illegal, harmful, threatening, abusive, or otherwise objectionable content
  • Upload content depicting minors or non-consensual imagery
  • Use the Service to create deceptive or fraudulent advertising
  • Attempt to reverse engineer, decompile, or hack the Service
  • Use automated systems to access the Service without permission
  • Interfere with or disrupt the Service or servers
  • Violate any applicable laws or regulations

We reserve the right to suspend or terminate accounts that violate these obligations.

5. Intellectual Property

Your Content

You retain ownership of all content you upload to the Service, including product images and brand assets. By uploading content, you grant us a limited, non-exclusive license to:

  • Process your content to provide the Service
  • Store your content temporarily as needed for processing
  • Create derivative works (the generated outputs) based on your content

This license terminates when you delete your content or close your account.

Generated Content

You own the generated outputs (hero images and videos) created using the Service, subject to the following:

  • You must have the rights to the source content used to generate outputs
  • You are responsible for ensuring generated content complies with applicable laws
  • We do not guarantee generated content is free from third-party claims

Our Platform

The MotionFy platform, including its design, features, and underlying technology, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our platform without permission.

6. Payment Terms

Certain features of the Service may require payment. By subscribing to a paid plan:

  • You agree to pay all applicable fees as described at the time of purchase
  • Payments are non-refundable except as required by law or stated in our refund policy
  • We may change pricing with reasonable notice
  • You are responsible for any applicable taxes

7. Limitation of Liability

To the maximum extent permitted by law:

  • Your violation of any third-party rights

9. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms or for any other reason with reasonable notice.

Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

10. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting updated Terms on this page and, where appropriate, via email.

Continued use of the Service after changes constitutes acceptance of the modified Terms.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which MotionFy operates. Any disputes arising from these Terms or the Service will be resolved through good-faith negotiation or, if necessary, binding arbitration.
